The Website does not create user accounts or deliver advisory services directly. Engagement for advisory services occurs separately through individual statements of work and written agreements.

- Use automated tools to scrape, crawl, or harvest content from the Website without authorization

- Impersonate JHarris Advisory LLC, Jeremy Harris, or any other person or entity

6. Forms, Assessments, and Communications

Contact form. When you submit an inquiry through the Website's contact form, you understand and agree that:

- Submission of the form does not create an attorney-client relationship or any advisory engagement

- Information submitted through the contact form is processed through HubSpot, a third-party platform, consistent with our Privacy Policy

- We will respond to inquiries at our discretion and within a reasonable time, but are not obligated to respond to every submission

- You should not submit confidential or sensitive information through the contact form

Self-assessment tools. The Website offers free interactive self-assessments. Your responses to assessment questions are processed in your browser and are not transmitted to JHarris Advisory LLC. Closing the tab clears them. If you request a full report, we collect only the name and email address you provide for that purpose. Assessment results are educational estimates based on the information you enter. They are not audits, certifications, legal opinions, or determinations of compliance, and they do not create any engagement.

Marketing communications. Consent to receive marketing email is requested separately from any report request and is never required to receive your assessment score or report. You may unsubscribe at any time.

7. Purchases and Digital Products

The Website offers digital products, including compliance toolkits, templates, checklists, and related materials, for purchase and immediate download.

All purchases are governed by the Toolkit Terms of Sale and License, which address license scope, permitted and prohibited uses, delivery, the update period, refunds, and product-specific disclaimers. You should read those terms before purchasing.

By completing a purchase you confirm that:

- You are authorized to bind the organization named at checkout, if you are purchasing on its behalf

- You have read and accept the Toolkit Terms of Sale and License in effect at the time of purchase

- You understand that purchased materials are educational templates and not legal advice

All sales are final. Digital products are delivered immediately and cannot be returned. Please review the product description and the Toolkit Terms before completing your purchase. See Section 8 of the Toolkit Terms for the full refund provision and the limited circumstances in which we will correct a fulfillment failure.

Payment processing is handled by Squarespace Payments. JHarris Advisory LLC does not receive or store your full payment card details.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JHARRIS ADVISORY LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE, ITS CONTENT, OR ANY PRODUCT PURCHASED THROUGH IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Subject to the following sentence, in no event shall JHarris Advisory LLC's total liability to you for any claim arising out of or related to these Terms or your use of the Website exceed one hundred dollars ($100.00).

For any claim arising out of or related to a digital product you purchased through the Website, JHarris Advisory LLC's total liability shall not exceed the amount you actually paid for that product.

Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify, defend, and hold harmless JHarris Advisory LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Website, your use of any product purchased through it, your violation of these Terms, or your violation of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms, your use of the Website, or any product purchased through it shall be resolved exclusively in the state or federal courts located in Sacramento County, California, and you consent to the personal jurisdiction of those courts.

We reserve the right to modify these Terms of Use at any time. Changes will be effective upon posting to the Website with an updated "Current as of" date. Your continued use of the Website following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

Changes to these Terms do not alter the terms that applied to a completed purchase. Each purchase is governed by the Toolkit Terms of Sale and License in effect on the date of that purchase.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the enforceability of the remaining provisions.

15. Entire Agreement

These Terms of Use, together with our Privacy Policy and, for purchased digital products, the Toolkit Terms of Sale and License, constitute the entire agreement between you and JHarris Advisory LLC with respect to your use of the Website and supersede all prior agreements, representations, and understandings relating to the same subject matter.
